Attachment B Drought Declaration NOTICE: DECLARATION OF WATER SHORTAGE AND GUIDELINES FOR WATER USE RESTRICTIONS

WHEREAS, the Water Services Director has determined that the Water Services Department will be unable to adequately meet unrestricted peak water demand in that portion of the Water Services Department service area {geographic description} unless the Director limits demand on the available water supply in said area (see map);

WHEREAS, {situation requiring restrictions} resulting in a {short term} inability to meet unrestricted demand for water;

WHEREAS, the Director has the authority under Chapter 37 of the Phoenix City Code entitled "Water;" specifically Article I, section 37-3, decision-making authority, and section 37-13, to establish and enforce rules and regulations pertaining to use of water from fire hydrants; Article X, sections 37-125 through 37-132 as amended, to declare a drought or short term delivery insufficiency condition and proscribe certain uses of water for the duration of the drought or insufficiency, or during a sewer flow emergency;

THEREFORE, the Director, in order to temporarily reduce demand in the aforementioned area hereby gives notice of and takes the following actions:

1. A Stage {level of drought per drought ordinance} drought is hereby declared to be in effect in {geographic description}.

2. The following priority of use for delivery of water is set forth: First, all existing regularly metered residential customers; second all regularly metered commercial customers; third all uses of water, other than fire hydrant use, for new construction; fourth fire hydrant use for landscape irrigation or lakes; fifth for all other construction fire hydrant use, metered or unmetered.

3. Curtailment of use will begin with the least priority use listed above at any time the Department projects or determines it will be unable to maintain an acceptable level in reservoir(s.)

The above restrictions are deemed to be in full force and effect upon the filing of this declaration with the City Clerk, and will remain in full force and effect until rescinded by the Director or his delegated representative.
