Request that the City Council hold a public hearing and approve the rezoning for the following item by adopting the Planning Commission's recommendation:

The following stipulations are subject to discussion at the meeting and the City Council may add, delete, or amend stipulations:
Stipulations
1.
That the development shall be in general conformance with the site plan date stamped July 17, 2008, as approved or modified by the Development Services Department.
2.
That the development shall be in general conformance with the landscape plan date stamped July 17, 2008, with specific regard to the quantity and type of trees at the following locations, as approved or modified by the Development Services Department:
a.
Along the multi-use trail to the north and west of the site;
b.
Along 99th Avenue with the exception of the existing Salt River Project easement, public utility easement, and possible deceleration lane.
3.
That all elevations of the primary structures, clubhouse, and garage units shall contain similar architectural elements and detailing such as textural changes, pilasters, offsets, decorative garage doors, recesses, variation in window size and location, and overhang canopies on all sides of the structure, as approved by the Development Services Department.
4.
That all garage units located on the north and west borders of the property shall contain architectural embellishments or trellises on the rear of the garage structures that face the multiuse trail; as approved by the Development Services Department.
5.
That the maximum number of dwelling units shall not exceed 220.
6.
That all south facing windows shall contain elements that limit sun exposure through the use of shade or solar screens, as approved by the Development Services Department.
7.
That all pedestrian walkways shall be shaded at a minimum of 75 percent at noon on the summer solstice and connect residential buildings to the multi-use trail, other buildings, site amenities, and 99th Avenue; as approved by the Development Services Department.
8.
That all sidewalks, trails, or pedestrian pathways when crossing parking surfaces or drive isles, shall be constructed of decorative pavers, stamped or colored concrete, or another material different than the primary paving material, as approved by the Development Services Department.
9.
That two shaded benches shall be provided along the multi-use trail located along the north and west property lines, as approved by the Development Services Department.
10.
That view fencing shall be required at the following locations, as approved by the Development Services Department:
a.
Along the north and west borders of the site between the multi-use trail and the parking lot;
b.
Along 99th Avenue.
11.
That the property owner shall record documents that disclose the existence and operational characteristics of Phoenix Goodyear Airport to future owners or tenants of the property. The form and content of such documents shall be according to the templates and instructions provided which have been reviewed and approved by the City Attorney.
