Request that the City Council hold a public hearing and approve the rezoning for the following item by adopting the Planning Commission's recommendation and the related ordinance:

The following stipulations are subject to discussion at the meeting and the City Council may add, delete or amend stipulations:

 

Stipulations

 

GENERAL

 

1.

That the development shall be in general conformance with the site plan and elevations date stamped June 6, 2008, as modified by the following stipulations and approved by the Development Services Department.

 

 

 

2.

That the exterior building, roofing, fencing colors, and materials that are visible from adjacent property or adjacent streets shall convey color, form, textures, and materials that blend with natural conditions of the area, as approved by the Development Services Department.

 

 

3.

That all building envelopes shall be located no higher than the 20 percent slope line, with the exception of three building envelopes that may be located no higher than the 25 percent slope line, as approved by the Development Services Department.

 

 

4.

That the development shall not exceed nine hillside dwelling units.

 

 

5.

That prior to preliminary site plan approval, a landscape inventory plan shall be submitted that identifies all Saguaro cacti and trees greater than or equal to three-inch caliper. The placement of all building envelopes shall demonstrate that these specimens are preserved in place or replaced onsite, as approved by the Development Services Department.

 

 

6.

That disturbed hillside areas shall be revegetated to prevent erosion and establish plant material of similar type, size, coloration, and amount as the context area when mature, as approved by the Development Services Department.

 

 

7.

That the grading of a hillside lot shall minimize visible cut and fill to encourage gradual topographical transitions that blend with the natural grade and reduce visual scarring, as approved by the Development Services Department.

 

 

8.

That there shall be no fence on the perimeter of the site, as approved by the Development Services Department.

 

 

9.

That pedestrian access shall be provided to the Western Canal as approved by the Development Services Department.

 

 

9. 10.

The developer shall construct all streets within and adjacent to the development with paving, curb, gutter, sidewalk, curb ramps, streetlights, median islands, landscaping, and other incidentals as per plans approved by the Development Services Department. All improvements shall comply with all Americans with Disabilities Act (ADA) accessibility standards.

 

 

10. 11.

That the maximum number of lots shall not exceed 14.

 

 

11. 12.

That if developed with private streets, bollard lighting shall be utilized for street lighting, as approved by the Development Services Department.

 

 

12. 13.

That the landscape, lighting, and sign plans shall be presented to the Village Planning Committee for review and comment prior to preliminary site approval by the Development Services Department.

 

 

13. 14.

That all mechanical equipment such as satellite dishes and L.P. gas tanks shall be placed behind screen walls, as approved by the Development Services Department.

 

 

14. 15.

That any request to change or modify stipulations or the site plan shall be preceded by a presentation to the Laveen Village Planning Committee for review and comment prior to submittal to the city.
