Request to hold a public hearing and approve the rezoning for the following item and adopt the related ordinance.

October 7, 2008 - Motion failed to approve, subject to stipulations with the deletion of Stipulation 2 and modifications to Stipulation 6 and 10. Vote 4-4 (No recommendation forwarded for consideration as no further motion was made.)

 

The following stipulations are subject to discussion at the meeting and the City Council may add, delete, or amend stipulations.

 

In the event the application is approved, staff recommends the following stipulations:

 

Stipulations

 

1.

That an average 25-foot landscape setback shall be provided along Cave Creek Road and Danbury Road, as approved by the Development Services Department.

 

 

2.

That 65 feet of right-of-way shall be dedicated for Cave Creek Road and 25 feet of right-of-way shall be dedicated for Danbury Road, as approved by the Development Services Department.

 

 

3.

That vehicle display areas shall be limited to the area along Cave Creek Road not to exceed five vehicles at any one time.

 

 

4.

That refuse collection areas shall be fully screened with a decorative wall and opaque doors, as approved by the Development Services Department.

 

 

5.

That the chain link fencing and barbed wire shall be removed. Should fencing or perimeter walls be provided, they shall have a finished appearance, as approved by the Development Services Department.

 

 

6.

That a cross access agreement and cross parking agreement shall be pursued with the property owner to the north.

 

 

7.

That the property owner shall record documents that disclose the existence and operational characteristics of the Phoenix Deer Valley Airport to future owners or tenants of the property. The form and content of such documents shall be according to the templates and instructions provided which have been reviewed and approved by the City Attorney.

 

 

8.

That the developer shall construct all streets within and adjacent to the development with paving, curb, gutter, sidewalk, curb ramps, streetlights, median islands, landscaping, and other incidentals as per plans approved by the Development Services Department. All improvements shall comply with all Americans with Disabilities Act (ADA) accessibility standards.

 

 

9.

That the applicant shall complete and submit the Developer Project Information Form for the Maricopa Association of Governments Transportation Improvement Program with the Street Transportation Department.

 

 

10.

That the applicant shall submit documentation of compliance with Stipulations 1, 2, 4, 5, and 6 within one year of City Council approval to be administratively verified by the Planning Hearing Officer.
