This report provides advance notice of liquor license applications that were received by the City Clerk during the period of Wednesday, June 4, 2008 through Tuesday, June 10, 2008.

 

INFORMATION

The liquor license application process includes the posting of a public notice of the application at the proposed location for twenty days and the distribution of an application copy or a copy of this report to the following departments for their review: Finance, Planning, Police, Fire, Street Transportation, Development Services, and the Maricopa County Health Department.  Additionally, License Services mails a notice to all registered neighborhood organizations within a one-mile radius of each proposed business location (excluding Special Events).

 

Additional information on the items listed below is generally not available until the twenty-day posting/review period has expired.

Text Box: LIQUOR LICENSE INVESTIGATION SUMMARY

The Police Department recommends disapproval of this liquor license application for the following reasons:

 

The following criminal activity has occurred at other locations under the control of the applicant:

 

        The applicant, Maria Hernandez, stated that since 2001 she has worked as a bar attendant at a bar owned by her husband, Jose Carmen Hernandez. The bar, The Combos Club, is located at 6444 West Glendale Avenue. Jose also owns another bar called the Combos Club located at 1241 E. Broadway Rd in Mesa. The licenses for both businesses are owned by J C Anguiano Inc. for which Jose Hernandez is president and sole stockholder. 

 

        The Glendale Combos Club has a history of violence and liquor license violations. Liquor violations which have occurred there since 2005 are: 8 counts of underage on premises without a parent, 1 count of failure to request ID from an underage buyer, 1 count sell, give, furnish an underage person with alcohol and 1 count drinking contest, delivering more than the law allows. Collectively since 2005, fines totaling $14,750 and three days of suspension have been sanctioned against the license.

 

        In April 2008, the Glendale Liquor Task Force conducted an inspection of the Combos Club. The inspection was based on the high number of calls for service being generated by activities at the bar. The inspection resulted in the bar being temporarily closed by the building safety inspector who declared that on the date of inspection the bar was unsafe to occupy.

 

        During the inspection Sgt. Bob Dorn with Department of Liquor Licenses and Control noted the following violations: unauthorized alcoholic beverages on premises, ARS 4-243.01/ R19-1-220, storage on unlicensed premises, R19-1-219 and failure to notify change of premises, ARS 4-4-207.01.B. Resulting from these violations and previous liquor violations, the Glendale Combos Club license was suspended for 10 business days spanning four weekends starting June 12th, ordered to pay $10,000 in fines, and ordered to sell the business and divest the license no later than November 30, 2008, or the license will be placed inactive.

 

        There are possible hidden ownership concerns:

        During an interview with Maria she stated that the funds to purchase the business came primarily from refinancing the residence owned by her and Jose. The refinance occurred in 2006 and Maria said that in the interim the funds were kept in a bank account belonging solely to Jose. The finances for the purchase of this business, for which Maria claims sole ownership, came from Jose’s account. Jose is not listed on the liquor license application which was submitted as an individual ownership. The failure to disclose Jose on this application appears to be intentional due to problems related to his current liquor license.

 

  Other

On May 13, 2008, Maria submitted the city questionnaire at City Licensing and was advised regarding two amusement licenses which would be required for her business due to the number of games/amusements which she planned to operate. Maria stated that she would return the next day to apply for the licenses but failed to do so. On May 30th, Maria was interviewed regarding her liquor application at her business. On that date, eleven games were operating in violation of city amusement codes. A departmental report requesting prosecution for the violation will be submitted.

 

Maria stated that while working at her husband’s bar in Glendale, her responsibilities consisted mostly of basic office work. She further stated that hers was not a management position. Therefore, Maria has no experience controlling a liquor license. The bar that she has purchased is located in a high crime area and is a business with a history of violent crimes and drugs sales facilitated by employees of the bar. Maria has no security plan for overcoming the history of problems at the bar other than to hire security guards.

 

For the above reasons, Maria has failed to demonstrate the reliability, capability and qualification to responsibly control a liquor license.
